...Attorney/Agent

Definition:  The agent or correspondent acting on behalf of the patent applicant.

Information in this field is varied in terms of content, sometimes including just the name of a company or a law firm, but often also including address information.

In the case of US applications, which are often published without assignee information, correspondent information can be helpful in inferring the assignee. Since the correspondent information often includes the company name, elements of the company's address, or a  particular person associated with the company, sometimes in-house counsel, it can be used to advantage in searching, alerting, or otherwise tracking companies of interest.

Tips
  1. Searches in this field can include company names, law firm names, names of individuals, or elements of an address.

  2. Because this data comes from a number of patenting authorities and is not standardized, the best way to search for more than one term within this field is with the AND operator.

  3. Searching the primary field (Agent/Correspondent) automatically searches the sub fields.  To limit your search to just one version/instance, use the appropriate sub field.

ECLA

Definition:  The European Patent Office Classification code to which this patent is assigned.

Although ECLA is applied to all authorities, it is not present in all records.  The general goal of the EPO in applying ECLA is to ensure that at least one member of each patent family has an ECLA classification.

ECLA codes can be broken down in the following manner:

  • Section

  • Class

  • Subclass

  • Main group

  • Subgroup

Sections are the highest level of hierarchy of the classification.

Each section is subdivided into classes.

Each class comprises one or more subclasses.

Each subclass is broken down into subdivisions referred to as groups, which are either main groups (i.e., the fourth hierarchical level of the classification) or subgroups (i.e., lower hierarchical levels dependent upon the main group level of the classification).  Subgroup codes contain a minimum of two characters.

An ECLA that displays on a Thomson Innovation record view as C0714/175 can be broken down as follows:

Section
Class
Subclass
Main group
Subgroup

C

07

K

14

175

The main group portion of the ECLA must be zero filled (to the left) to four digits for searching and all punctuation must be removed.  So, the ECLA shown on a record view as C0714/175 is searched as C07K0014175.

ECLA codes on the Thomson Innovation record view are hyperlinked and clicking a link will generate a result set based on that ECLA for exploration of those related codes.

Definition:  The International Patent Classification code to which this patent is assigned.

This classification system is administered by the World Intellectual Property Organization (WIPO).

Advanced Level

The Advanced level of classification represents the complete IPC that began in January 2006 with the roll out of IPC-R (also called IPC Reform and IPC-8) with a similar breakdown of subgroups as the previous IPC-7. The Advanced level will be revised on the order of every three months to allow for its rapid adaptation to cover emerging technologies. Advanced IPC classification will be useful for a precisely focused search and when capturing documents published by the major authorities is sufficient.

The Advanced level will be used by large patent offices, which include at least those offices included in the PCT Minimum Documentation.

All documents classified at the Advanced level will also have a Core level classification that is automatically generated from the Advanced code. The Core level classification may sometimes be identical to the Advanced level.

Core Level

The Core level of IPC-R is a subset of the Advanced classification scheme with significantly fewer numbers of subgroups, primarily (but not only) those at the main group level (having a subgroup of 00). This "light and stable" version of the IPC will be used by small and medium patent offices, and its classification scheme will be updated only every three years.

Searching at the Core level will be more generic, and will result in more results, but will extend the search to those smaller patent publishing authorities that use the Core level.

In addition to Advanced or Core Level distinctions within IPC-R, it may sometimes occur that a patent document is published with only a 4-character IPC Classification code. In this case, the IPC-R code will be tagged as Subclass-level classification.

Subclass Level

In addition to Advanced or Core Level distinctions within IPC-R, sometimes a patent document is published with only a 4-character IPC Classification code. In that case, the IPC-R code will be tagged as Subclass-level classification.

Invention and Additional (Value) Attributes

IPC-R defines two types of information found in patent documents:

  • Invention information

  • Additional information

According to WIPO:

"Invention information is technical information in the total disclosure of a patent document (for example, description, drawings, claims) that represents an addition to the state of the art. The Invention information is determined in the context of the state of the art, using guidance provided by the claims of the patent document, with due regard given to the description and the drawings.

Additional information is non-trivial technical information which does not in itself represent an addition to the state of the art but might constitute useful information for the searcher."

In contrast to Main Classification in pre-reform IPC (IPC-7 and earlier), there can be more than one Invention classification for a given document in IPC-R.

Version

In place of formerly used "edition," each new classification subgroup that is created in the ongoing revision of IPC-R will carry with it a creation date, which is called "version." It will be printed on the document in the format YYYYMM and seen in the database record with a full date, YYYYMMMDD. This version number signals the date on which this particular subgroup came into effect.

Revision Cycle

The Core level will be revised every three years. The Advanced level will be revised every three months.

Reclassification

Prior to 2006, revisions to the IPC were introduced at 5-year intervals, and as each new edition was published, its classification would be applied to documents from that date forward. With IPC-R, the entire backfile of published patent documents is being reclassified, and ongoing changes to the IPC classification scheme will result in reclassification of all previously published documents that are affected by the change in the class scheme.

Layout of Classification Symbols
  • Sections

  • Classes

  • Subclasses

  • Groups

  • Subgroups

The classification represents the whole body of knowledge which may be regarded as proper to the field of patents for invention, divided into eight sections. Sections are the highest level of hierarchy of the classification.

Each section is subdivided into classes. Classes are the second hierarchical level of the classification.

Each class comprises one or more subclasses. Subclasses are the third hierarchical level of the classification.

Each subclass is broken down into subdivisions referred to as "groups," which are either main groups (i.e., the fourth hierarchical level of the classification) or subgroups (i.e., lower hierarchical levels dependent upon the main group level of the classification).

IPC-R format is shown below:

...US Reassignment Reel-Frame

Definition:  Patent assignments reported to the USPTO after initial issuance of the patent (post-issuance).

Reporting is a voluntary process, and, therefore, not comprehensive. Numerous events in addition to true assignments are reported in this manner and these can be important for establishing a chain of title with respect to a particular patent.

The Assignee is the recipient of the transfer of ownership.

The Assignor is the owner who is transferring the ownership.

The Date is the date the transfer was recorded.

The Conveyance information describes the transaction.  It can include phrases like: assignment of assignor's interest, judgement, license, merger, release, sale, security agreement, security interest, or settlement.

The Reel-Frame is the microfiche reel and frame that show the record of this reassignment.

DWPI Basic/Equivalent

Definition: A patent that is classified as the DWPI Basic/Equivalent is the DWPI family basic patent, the first member of the patent family to be entered into the DWPI database.

Basics are identified by comparing the priority data on a newly received patent document with the priority data already in the DWPI database. If the priority data on the new document does not match the priority data of any previously processed document, then the new document is considered to be Basic and a new DWPI record is created with a unique Primary Accession Number.

DWPI Chemical Link Codes
DWPI Chemical Unlink Codes

Definition:  These fields contain alpha-numeric codes which describe both single compounds and Markush compounds (special chemical structures with many variable fragments) disclosed or claimed in patent specifications, on the basis of the structural fragments found in these compounds.

All possible chemical permutations covered by the patent are separated into appropriate chemical fragments, and these fragments are then translated into alpha-numeric chemical codes. Non-structural codes are also included to describe biological activity, formulation, use or property disclosed in the patent document.

The chemical indexing system is divided into a number of subsets (M0-M6) which are both year and subject-oriented:

  • M0 All pre-1970 Agricultural, Pharmaceutical Non-Steroids (1963-1969)

  • M1 Agricultural, Pharmaceutical - Natural Products & Polymers (1970 to present)

  • M2 General Chemical - Agricultural, Pharmaceutical (1970 to present)

  • M3 General Chemical - Other (1970 to present)

DWPI Class
...DWPI Manual Code
......DWPI Manual Code-Chemical
......DWPI Manual Code-Mechanical

Definition:  The DWPI collection categorizes patent documents using a simple classification system for all areas of technology. Subject specialists have consistently applied this unique classification system to all patent documents since 1970. The DWPI Classifications provide a uniform and accurate indexing tool that will allow you to effectively clarify ambiguous keywords and broaden or narrow your subject/keyword searches.

All technologies are covered by 20 subject areas designated:

  • A to M Chemical (1970)

  • P to Q Engineering (1974)

  • S to X  Electrical & Electronic (1974)

Each of the 20 subject areas is further subdivided into 3-character classes. Each DWPI Class consists of a letter followed by two digits, and has the format has the format ANN.

The classification for A-M and S-X is applied by DWPI subject matter experts. Classes for the Engineering sections P-Q are derived automatically from the International Patent Classification (IPC).

Inventor-DWPI

Definition:  The name of the person, persons, or organization registered as the inventor.

From 1978 until 1980, records were limited to three inventor names with up to 10 characters each. From 1980 to 1992, records were restricted to a maximum of eight inventors, with the exception of Soviet patents, which retained a limit of three. Since DWPI Update 9216 in 1992, there is no limit on the number of inventor names or the length of individual inventor surnames and initials included in a record.

DWPI Update

Definition:  This is a unique identification number assigned to each DWPI database update and comprises a 4-digit year followed by a 2-digit serial number, representing the year of the update and the number of the update, respectively.

New updates are currently added to the database approximately every 3 working days.

The DWPI Update represents a production period, and so may contain a mixture of publication dates for individual countries, subject to the volume fluctuations encountered each week. The aim is to cover as high a percentage of each publication date range as possible within an update, prioritizing any excess coverage for subsequent updates.
